1 About these terms
These Terms and Conditions govern access to and use of billowspsychology.com (the Website). The Website is operated by Helen Billows, sole trader, trading as Billows Psychology, ABN 14 155 100 303. Helen Billows is a registered psychologist in Australia, registration number PSY0002178432.
References to Billows Psychology mean Helen Billows acting through that clinical practice. References to you or your mean a person who accesses the Website, submits an enquiry, requests an appointment or seeks information about a service. Questions about these Terms may be sent to admin@billowspsychology.com.
These Terms govern the Website. Psychological therapy and professional supervision or consultation are governed by separate consent or service agreements. A signed or expressly accepted service agreement prevails over these Terms in relation to the professional service to the extent of any inconsistency. These Terms continue to govern use of the Website.
By accessing or using the Website or submitting an enquiry, you agree to these Terms to the extent relevant to that activity. If you do not agree, do not access or use the Website or submit information through it.
2 Nature of the Website
The Website provides general information about Billows Psychology, Helen Billows, psychological therapy, trauma, EMDR, professional supervision and consultation. Public website information is not individual psychological advice, assessment, diagnosis, treatment, crisis support or professional supervision.
Accessing the Website, submitting a form, sending an email or receiving an administrative response does not establish a psychologist-client, supervisor-supervisee or consultant-participant relationship. A professional relationship begins only when Helen Billows has agreed to provide the service and the relevant consent or service agreement has been completed.
3 Clinical and professional services
Billows Psychology provides psychological therapy to adults and professional supervision or consultation to eligible practitioners. Suitability is determined individually. Billows Psychology may decline an enquiry, recommend another service or end a service in accordance with the applicable professional agreement, ethical obligations and law.
Therapy is governed by the client consent and service agreement. Supervision and consultation are governed by the Professional Supervision and Consultation Agreement or another written agreement supplied for that service. Website descriptions do not replace those documents.
Submitting an enquiry does not guarantee acceptance, availability, a particular appointment time or suitability for a service. An appointment is confirmed only when Billows Psychology issues confirmation and any required prepayment or documentation has been completed.
4 Not a crisis service
The Website, email address, enquiry form and administrative team are not monitored crisis or emergency services. Do not use them for urgent or emergency communication.
If a person is in immediate danger in Australia, call 000. For 24-hour crisis support in Australia, call Lifeline on 13 11 14. A person outside Australia should contact the local emergency or crisis service.
5 Fees bookings and cancellations
Current fees, payment requirements and general cancellation information are displayed on the Website. The applicable consent or service agreement and information confirmed at booking govern the appointment.
A first therapy appointment requires full prepayment to secure the booking. Established clients are only required to pay on the day of service. Unless a different written arrangement applies, at least 48 hours notice is required to cancel or reschedule an appointment. A late cancellation or non-attendance will ordinarily incur the full appointment fee because the reserved time cannot usually be offered to another person at short notice.
Medicare and private health rebates are generally not available for cancellation fees. A request concerning exceptional circumstances may be considered reasonably and consistently, but no outcome is guaranteed. Nothing in a cancellation policy excludes a right or remedy that cannot lawfully be excluded.
If Billows Psychology cancels an appointment, no cancellation fee applies. Any prepaid amount will be transferred to a replacement appointment or refunded, as agreed.
6 Medicare referrals and private health
Information about Medicare or private health rebates is general and may change. Eligibility depends on the applicable rules, a valid referral or plan where required, the service delivered and the individual's circumstances. Clients remain responsible for confirming eligibility with the relevant referrer, Medicare or insurer.
Billows Psychology may assist with submitting an eligible Medicare claim after payment but cannot guarantee the timing or outcome of a rebate. Private health claims are ordinarily made directly by the client unless another arrangement is confirmed.
7 Telehealth and electronic communication
Telehealth may be provided through Zoom or another approved platform. Professional services are not provided by ordinary website browsing, social media, public comments or unarranged email exchanges.
Internet, email and telehealth systems can experience interruption, delay or security incidents. Billows Psychology takes reasonable steps to use appropriate systems but cannot guarantee uninterrupted operation or absolute security. Service-specific telehealth risks, privacy arrangements and contingency procedures are addressed in the relevant consent or service agreement.
8 Intellectual property
Unless otherwise stated, the Website and its content are owned by or licensed to Helen Billows. This includes the Billows Psychology name, business names, logos, trade marks, text, service descriptions, articles, graphics, photographs, recordings, frameworks, worksheets and downloadable materials.
Website content may be viewed and reasonable extracts may be printed for personal, non-commercial reference. Content must not be copied, republished, recorded, modified, distributed, sold, used to train an artificial intelligence system, presented as another person's work or used commercially without prior written permission, except where law permits the use without permission.
Nothing on the Website transfers ownership of intellectual property or grants a licence to use the Billows Psychology name, Helen Billows name, logos, trade marks or branding.
9 Acceptable Website use
A person using the Website must not:
attempt to obtain unauthorised access to the Website, forms, systems or another person's information;
interfere with security, access controls or normal Website operation;
introduce malicious code or use automated scraping or extraction tools;
submit unlawful, threatening, defamatory, abusive or deliberately misleading material;
submit information about another person without lawful authority; or
infringe intellectual property, privacy or other legal rights.
Access may be restricted where reasonably necessary to protect the Website, the practice, clients, other users or legal rights.
10 Website security and availability
Billows Psychology takes reasonable steps to maintain the Website and protect information under its control. No website, transmission or storage system can be guaranteed completely secure, error-free or continuously available.
The Website may be interrupted for maintenance, security, provider outages or circumstances outside reasonable control. Billows Psychology does not promise that every error will be corrected immediately or that the Website will be compatible with every device or browser.
11 Third-party links and services
The Website may link to external websites, Medicare information, professional bodies, emergency services, booking tools or other third-party services. A link is provided for convenience and does not necessarily endorse every statement, product or practice of the third party.
Billows Psychology does not control third-party availability, security, content or privacy practices. A person's direct use of a third-party service is governed by that provider's terms and privacy practices.
12 Privacy
Personal and health information is handled in accordance with the Billows Psychology Privacy Policy and the applicable professional consent or service agreement. The Privacy Policy forms part of these Terms for Website use.
13 Disclaimer and consumer rights
The Website and Clinical Information Disclaimer forms part of these Terms. Professional services are provided with the care, skill and professional obligations required by applicable law and standards.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, professional duty, right, remedy or liability that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.
To the maximum extent permitted by law, Billows Psychology is not liable for loss caused by using general Website information as though it were personalised professional advice, by unlawful or unauthorised Website use, or by an event outside reasonable control. This limitation does not apply to professional services actually delivered under an established service relationship or to liability that cannot lawfully be limited.
14 Changes
Billows Psychology may correct or update the Website and these Terms. The current version will be published with its update date. A change to Website terms does not retrospectively alter a signed professional service agreement unless the agreement or law permits the change and any required notice or consent is provided.
15 General provisions
If a provision is unlawful or unenforceable, it is to be read down to the extent necessary or severed, and the remaining provisions continue to apply. A failure or delay in enforcing a right is not a waiver of that right.
16 Governing law
These Terms are governed by the laws of South Australia and the applicable laws of the Commonwealth of Australia. The courts of South Australia have non-exclusive jurisdiction. A person retains the benefit of any mandatory law that applies and cannot lawfully be excluded.
